STEP 3:  FILING THE CASE &  ORDERS:

The amount of this step depends on whether the tenants respond to the lawsuit.  If the tenant do not respond, we  must motion the court for an automatic (default) eviction (Step 4 skipped).  If the do tenant respond, we must schedule a court (show cause) hearing on ten (10) days notice. (Step 4).

 One of more orders may be obtained in this stage, depending on the facts of your case:
 If the tenant fails to respond to the lawsuit, then they are in default.  This means that we can motion the court for an Order of Default and Writ of Restitution to evict immediately and without a court hearing
 If the tenants do respond to the lawsuit, we will need to schedule a show cause hearing, which means setting up a court date.  The court will order that both parties attend this hearing.  The court date must be scheduled on ten days notice to the defendant

Order of Default: 

 If Tenant does NOT respond to the lawsuit, they are in default, which allows us to evict immediately without a court hearing.  Drafting Judgement, Order for Writ of Restitution, Order of Default, Motion/Declarations, Military Status Affidavit, case filing, ex parte submission of orders, scheduling eviction with Sheriff
